Collection and usage of personal data of customers, suppliers and other contractors

Please be aware that the personal data you provide us will be processed because it is necessary for concluding any agreements with each other and for the performance of such contracts. This applies both for our (potential) customers and for (sub-)suppliers of goods and/or services we do business with.

If you are a (potential) customer of Brainpact, your data will be processed for the following purposes: to send you quotations and offers, to determine to which specifications or needs certain goods or services need to be compliant with, to be able to supply goods or provide services, to submit invoices and to communicate effectively with each other in relation to the performance of the contract.

If you are a (potential) supplier of goods and/or services or another contractor of Brainpact your data will processed for the following purposes: to inform you to which specifications or needs certain goods or services need to be compliant with, to send a request for quotation, to place an order, to pay invoices and to communicate effectively with each other in relation to the performance of the contract.  

You are not obligated to provide us with personal data. However, if you do not or insufficiently disclose requested personal data to us, it may not be feasible to implement the aforementioned activities.

Transfer to third parties

In relation to the performance of any contract it is possible that personal data needs to be disclosed to third parties who supply parts, materials and products to us or carry out work assigned by us. Additionally, an external server space is utilized for the back-up of (parts of) our customer- and supplier administration, of which your personal data may form part. Your personal data will therefore be furnished to our provider of server space.   

Newsletters

If you order on a regular basis, your received personal data will be stored and processed to personally inform you in the future by e-mail of existing and new goods and/or services of Brainpact. For this purpose we have a legitimate interest, i.e. to promote and inform you of our products and services. Each time a newsletter is sent, you have the opportunity to unsubscribe if you do not wish to receive such mailings anymore. At the bottom of every newsletter there is a link that can be used to unsubscribe for these mailings.

Conservation period personal data

If you requested for a quotation or offer but have not become our customer, we will remove your personal data within one year from the date of our last contact, unless a longer period is necessary for the aforementioned purposes for which the personal data are processed.

If you sent us a quotation or offer, but have not become our supplier, we will remove your personal data within one year from the date of our last contact based on the same criterion.

In the event you have become our customer or vice versa, we will store your personal data for a period of seven years as from the end of the financial year in which the contract or other contracts resulting therefrom have fully been executed. The seven-year conservation period corresponds with the statutory obligation to retain administration data for the tax authorities. After the lapse of the aforementioned period we will remove your personal data.   

Rights of the data subject

In conformity with the GDPR you have, inter alia, the right to request access to your personal data. When justified, you can request for addition of personal data or rectification of inaccurate personal data. Furthermore, you have the right to erase your personal data or restrict the processing. Also, you have a right to object to processing of your personal data or submit a complaint to the Dutch Data Protection Authority. Finally, you may request to receive or transmit your personal data to a third party.
